General:
The Client acknowledges that these terms govern the legal rights and obligations between the Client and All Access Education Group Pty Ltd. All Access Education Group Pty Ltd may amend this agreement from time to time, and the Client agrees to changes when provided with 14 days notice
No variation or alteration of these terms by the Client or All Access Education Group Pty Ltd will be considered valid unless signed by the Managing Director or Chief Executive Officer.
Non-competition clause:
The client will not attempt to enter into a private or alternate arrangement with the tutor provided regarding payment of fees.
The client is not to enter into private arrangements and all bookings MUST be requested directly through All Access Education Group Pty Ltd. Attempts to enter into private arrangements with the tutor will result in termination of service immediately. All money paid upfront will be forfeited in this case.
Enrolment periods:
All Access Education’s term dates align with the Queensland state school calendar (usually 10 weeks per term,however some variation occurs in Term 4 for Senior Secondary students). The minimum enrolment period for recurring sessions is one school term, recurring weekly sessions will be booked as ongoing until notice is given to cancel the service.(see cancellation policy)
We do also accept ‘ad hoc’ sessions for specific assignment help.
All tutoring sessions are 1hr long unless otherwise organised with the parent/guardian and tutor.
Tutor allocation:
All attempts will be made by All Access Education Group Pty Ltd to assign a suitable tutor for the client. Suitability will be determined by teaching area, experience, personality and availability of the tutor.
In the event of the tutor being unsuitable, All Access Education Group Pty Ltd will provide alternative options of tutors.
If a suitable tutor is found, though the client is not satisfied, no money will be refunded.
The client agrees not to request services from All Access Education Group Pty Ltd that would be in breach of “academic integrity” rules. This includes but is not limited to assignment writing, essay editing or any activity that would be viewed as “cheating”.
Payment terms:
The cost per student is as advertised and discussed upon enrolment, it is subject to change given 14 days notice.
Payment for each tuition session is required prior to the commencement of the session. All Access Education reserves the right to refuse to deliver tuition services if payment is not received prior to the commencement of a session.
A single, upfront payment of tuition fees for the full term is preferred.
Please contact All Access Education to discuss alternative arrangements for payment of tuition fees if a single, upfront payment is unable to be made. We will require card or bank details to be securely saved to our system for automatic payments at regular intervals i.e. weekly, monthly, fortnightly. These payments are charged to the saved details on Friday prior to the session date.
Payment details can be found on the provided invoice, card and direct debit surcharges apply if these payment options are used.
Cancellation policy:
All scheduled sessions must be paid for, no fee free cancellations may occur.
Sessions can be rescheduled up to 2 hrs prior to the session start time.
Cancellations and reschedules less than 2 hrs prior to the session will be charged at the full rate.
If you attempt to reschedule and no tutor is available then a refund/credit will be applied
We do not guarantee reschedules occurring with the same tutor as your usual booking due to availability restrictions, although every effort will be made to keep the same tutor
If a student is unwell during a tutoring session in the centre or in person, a caregiver or an approved adult will be contacted to come and collect them. This is to ensure a healthy environment for all tutors and students. A make-up session will not be available in such circumstances.
If a tutor needs to reschedule or cancel a session every effort will be made to provide an alternative session time or day or tutor
ALL cancellations MUST be made via admin email, the Teachworks portal or by clicking the link to cancel on your session reminder email. The client agrees not to make cancellations directly with the tutor. Repeated attempts to avoid the cancellation policy will result in a cancellation of service and forfeit of prepaid sessions.
Management discretion can be applied in EXCEPTIONAL circumstances, this can only be applied by the Managing Director, Chief Operating Officer or Chief Executive Officer.
Termination of service:
Cancellation of service is only accepted at the end of the school term, there is no longer a two week cancellation policy and cancellations will only be accepted at the end of the school term. If tutoring is ceased in the middle of the term, the tutoring fees until the end of the term will remain liable to the customer.
Late payment fees
Late payment fees will be avoided as much as possible by All Access Education Group Pty Ltd. Though where appropriate and where it is deemed there is an “unwillingness” to pay unpaid money rather than an “inability” to pay, the following charges will apply. These fees are reasonable and appropriate, unpaid invoices are a consistent source of stress and create additional costs in attempting to recoup the owed funds. Fees may be waived in the event of EXCEPTIONAL circumstances, this can only be approved by the Managing Director or Chief Financial Officer.
Every attempt will be made in accordance with QLD debt collection laws to contact the debtor before applying fees.
14 days overdue - $5 administration fee
21 days overdue – Additional $5 administration fee
28 days overdue – Additional $5 administration fee
35 days overdue - $10 administration fee, letter of demand will be sent to your notified address.
If the invoice is still owing after 30 days, the following may occur:
Transfer of the debt to a collection agency who will apply their fees (typically 25-50% of the owed debt).
In the event of large debts owed and in the event All Access Education Group Pty Ltd will use the Queensland Civil and Administrative Tribunal to resolve the dispute and achieve payment of the money owed. Any and all fees associated with a QCAT tribunal hearing will be added onto the money owed and will exponentially increase the cost to the client. Fees may include; CEO/CFO fees for attending court, legal fees including initial consultation and representation in court among other reasonable and fair charges incurred by All Access Education Group Pty Ltd in the course of legal enforcement of the debt.
Liability
All Access Education Group Pty Ltd does not accept liability for claims of the client related to the provision of tutoring services.
No exclusion of liability exists that is not permissible by law
All Access Education Group Pty Ltd does not accept liability for consequences of tuition in the case of exam or assignment scores.
Protection of data
All personal data collected is secured safely and securely and only accessible to those authorised parties (the tutor(s) working with the student and management staff)
Child Safety
The client agrees to supervise the student undertaking tutoring in an open area of the house with an adult present when tutoring is provided at a private address/online.
All our tutors have working with childrens safety checks (Blue cards) and/or current Queensland college of teachers (QCT) registration, the numbers for which can be provided on request.
Queries and Complaints
All Access Education is committed to listening to any queries or concerns caregivers may have in relation to their child and tutoring sessions. The company requests that any concern is respectfully raised in private so that an opportunity is available to discuss a satisfactory solution to address concerns. All Access Education’s tutors share a common goal in assisting your child to reach their full potential in an engaging environment.
Client Code of Conduct
All students attending All Access Education have the right to learn in a safe and supportive environment. All students (and their caregivers) enrolled are expected to demonstrate a high level of respect towards tutors and fellow clients, and towards All Access Education’s property and premises. All Access Education expects students to actively engage with and participate in all tuition sessions, always follow instructions and act in a safe and respectful manner. In the event that a student (or caregiver) does not adhere to the company’s Code of Conduct, termination of tuition services may occur. Any prepayment made will be forfeited.
Safety and Security
All Access Education has a number of procedures in place to ensure the safety and wellbeing of all clients. Clients are required to leave our centres accompanied by a caregiver or approved adult (as identified on the Student Enrolment Form) as soon as their tuition session has ended. Clients will only be permitted to leave the centres without a caregiver or approved adult present if this option was selected on the Student Enrolment Form.
All Access Education is only responsible for a student during their allocated tutoring session time. The company and its tutors are unable to supervise students outside of their allocated tutoring time and take no responsibility for students arriving or leaving unaccompanied.
Students are required to arrive promptly for the beginning of their tutoring session. The student or their caregiver must sign in/out at the reception area to acknowledge the student’s arrival and departure times respectively. If a student is late to their tutoring session, the student will finish their session at the end of the allocated time. Sessions can not be extended to account for late arrivals, as this will disrupt other students and/or later sessions.
